Bequeathing one’s wealth to a number of institutes

Question:-

A man bequeaths 2.5% of his estate to a number of Islamic institutes. How will the funds be distributed?

Answer:-

If the 2.5% bequeathed falls within the 1/3 bracket (after settling burial expenses and outstanding debts), then it should be distributed equally amongst all the institutes listed as beneficiaries.

This is understood from the following text of Fataawa Hindiyya;

 

وَلَوْ أَوْصَى بِثُلُثِ مَالِهِ لِزَيْدٍ وَلِعَمْرٍو أو قال بين زَيْدٍ وَعَمْرٍو ثُمَّ مَاتَ الْمُوصِي ثُمَّ مَاتَ أَحَدُهُمَا فَنِصْفُ الثُّلُثِ لِلْبَاقِي وَنِصْفُهُ لِوَرَثَةِ الْمُوصَى له الْمَيِّتِ (الفتاوي الهندية105  ج5 )
