Changing Niyyat for Qurbani

QUESTION:-

After a Qurbaani has been made with the intention of Nafl, can it be changed to make intention of a Waajib? I did Qurbaani on behalf of my young son (nafl), and later came to know that there was a misunderstanding, and my mother thought I had made her Qurbaani as well. This was after the days of Eid. Can I change the intention of the Qurbaani that was supposed to be on behalf of my child, for my mother’s Waajib?

ANSWER:-

Since the Qurbani was carried out for your son, it is not possible to change your Niyyat now and intend your mother’s Qurbani. If your mother owned the Nisaab (which is approximately R8500.00) on the days of Eid, then Qurbaani was Waajib on her. If she missed her Waajib Qurbani, then she will be required to discharge the value of the Qurbani animal. If Qurbani was not Waajib upon her (due to not possessing the Nisaab on the days of Eid), then the value of the animal will not have to be given in Sadaqah.

وَأَمَّا الضَّحَايَا فَلَا بُدَّ فِيهَا مِنْ النِّيَّةِ، لَكِنْ عِنْدَ الشِّرَاءِ لَا عِنْدَ الذَّبْحِ. وَتَفَرَّعَ عَلَيْهِ أَنَّهُ لَوْ اشْتَرَاهَا بِنِيَّةِ الْأُضْحِيَّةِ فَذَبَحَهَا غَيْرُهُ بِلَا إذْنٍ، فَإِنْ أَخَذَهَا مَذْبُوحَةً وَلَمْ يَضْمَنْهُ أَجْزَأَتْهُ، وَإِنْ ضَمِنَهُ لَا (الاشباه والنظائر ص19 ج1)
