Enquiring about the status of meat at Dawats
QUESTION:
We exercise caution regarding meat sold at butcheries. When invited to a Dawat, would it be permissible to enquire from the host if the meat is hand-slaughtered and unstunned, or should we read Bismillah and entertain a good opinion of the host?
ANSWER:
It is generally expected that a Muslim will purchase and consume Halaal meat only, hence we are taught to entertain good thoughts of fellow Muslims and assume that the food or meat being served is 100% Halaal. Therefore, there is no need to enquire from the host whether the food is Halaal or not. As long as there is no certainty of the meat being Haraam, it will be assumed that the animal was slaughtered in accordance to Shariah and is suitable for consumption. However, if there is certainty that the meat was not slaughtered in accordance to the Shari’ee requirements of slaughtering, then one will be required to refrain from eating.
Notwithstanding the above, in majority of the current day abattoirs, it is unknown whether the slaughterers are reciting the Tasmiyah or not. Also, majority of abattoirs stun the animal before slaughtering. This is the same meat that is being sold in majority of the Muslim butcheries and is extremely doubtful. It is therefore advised, not to purchase meat from commercial abattoirs and from butchers who receive their meat from commercial abattoirs. Now, since there is a great deal of laxity in this regard nowadays, one should enquire the source of the meat from the host, or abstain from eating meat and meat products when invited to a Dawat, if asking the host might offend him.

وكذلك استدل بعضهم بما أخرجه البخاري من حديث عائشة رضي الله عنها: ((أن قوما قالوا للنبي صلى الله عليه وسلم: إن قوما يأتوننا بلحم لا ندري أذكر اسم الله عليه أم لا؟ فقال: “سموا عليه أنتم وكلوه “. قالت: وكانوا حديثي عهد بالكفر)) (1) ولكن هذا الحديث لا يتم به الاستدلال على حلة ما علم فيه باليقين أن ذابحه ترك التسمية عمدا، لأن غاية هذا الحديث حمل فعل المسلم على الوجه الصحيح، ومفاده أن المسلم إن قدم لحما أو طعاما، فالظاهر أنه حلال مذبوح بطريقة مشروعة، فيحمل على الظاهر، ونحن مأمورون بإحسان الظن بكل مسلم، فلا يجب البحث عن طريقة ذبحه، ما لم يتبين أنه ذبحه بطريقة غير مشروعة. وإن هؤلاء القوم الذين وقع السؤال عنهم كانوا مسلمين، وإن كانوا حديثي عهد بالكفر، كما صرحت به عائشة، فأمر رسول الله صلى الله عليه وسلم بحمل فعلهم على الظاهر، وهو أنهم ذكروا اسم الله عليه، ولا يلزم منه حل الذبيحة إذا تيقن الرجل بأن ذابحها ترك التسمية متعمدا. ومن البديهي أن هذا الحديث صريح في أن السؤال إنما كان عن حالة لا نعلم فيها بيقين أن الذابح المسلم سمي على الذبيحة أو لم يسم؛ وهذا هو الواقع الذي يقع لمعظم المسلمين في اللحم الذي يوجد في أسواق المسلمين، فإننا لم نشاهد الذين ذبحوه هل سموا عند الذبح أم لا؟ فالحديث يبين حكم هذه الحالة، وأين ذلك من الحالة التي نعلم فيها بيقين أن الذابح ترك التسمية عن قصد وعمد؟ وكيف تقاس الحالة الثانية على الأولى؟ وقد يستدل بعضهم بما رواه أبو داود في مراسيله عن الصلت السدوسي مرسلا, أن رسول الله صلى الله عليه وسلم قال: ((ذبيحة المسلم حلال، ذكر اسم الله أو لم يذكر، إن ذكر لم يذكر إلا اسم الله))
