QUESTION:
Some people donated toys to give to the poor or anyone in need. There was a toy that a child (of an average home) wanted. He has a car (more valuable) that can be given in lieu of the toy. Can he take the car and exchange it with this toy?
ANSWER:
The donor has given general permission to give it to whoever needs it; hence it can be given to any child that needs the toy, or to a poor child without taking an exchange in return. If the child (in question) needs the toy but wants to give an exchange and is of understanding age, then the transaction with be valid with the permission of his Wali (guardian).
(ولا يجوز تصرف الصغير) الغير المميز مطلقا، ولا المميز (إلا بإذن وليه) فإن أذن له وليه جاز تصرفه، لأن إذن الولي آية أهليته (اللباب ص66 ج2)
