Following one Mufti

QUESTION:

Kindly advise on the following:

I have been taught that Taqleed is Waajib in terms of Fiqh-related matters, hence we make Taqleed of the four Imaams. Due to multitude of Fitan that are present in the Ummah today, would it be Waajib to make Taqleed of a Fataawa department, or one of any of the Deeni institutes?

ANSWER:

The entire Ummah agrees that it is Waajib to follow a particular Madhab, and this is necessary for the management of the Ummah. If one moves away from Taqleed or chooses any ruling of his choice in the Madhab or out of the Madhab, then this is tantamount to following one’s desires, which is impermissible. Doing so is the result of being self-opiniated and an extremely dangerous practice that will distance one from the obedience of Allah Ta’ala and weaken the foundation of Deen. In conclusion, holding firmly onto one Madhab is for our protection, otherwise Shariah will become a joke if every person follows his desires. [Re:- Kitaab-un-Nawaazil Pg.139–143]   

Similarly, if one intends to protect his Deen in our times, then he should follow a pious and righteous Mufti whose objective is to please Allah and His Rasul Salallahu Alaihi Wasallam, and who issues Fataawa correctly as recorded by the Fuqaha in the Kitaabs of Fiqh. He should follow him in all related Fiqhi matters so that he is not confused with contradictory rulings. Although we cannot state that doing so is Waajib but it is best for one that intends safeguarding himself.
