Giving Ghusl to Shias on their demise
Question:-
Are we permitted to give Ghusl to the Shias on their demise or not?
Answer:-
It is imperative to understand that the Shias who reject the Sahaabiyyat of Hadrat Abu Bakr and Hadrat Umar Radiallahu Anhuma, or accuse Hadrat Aisha Radiallahu Anha of adultery (Allah forbid!), or believe that there are 40 Juz of the Quraan Sharif etc. are not considered as Muslims.
Fataawa Hindiyyah states:
مَنْ أَنْكَرَ إمَامَةَ أَبِي بَكْرٍ الصِّدِّيقِ رَضِيَ اللَّهُ عَنْهُ فَهُوَ كَافِرٌ، وَعَلَى قَوْلِ بَعْضِهِمْ هُوَ مُبْتَدِعٌ
وَلَيْسَ بِكَافِرٍ وَالصَّحِيحُ أَنَّهُ كَافِرٌ ) الفتاوي الهندية 2/264)
Whoever denies the Imaamah of Hadrat Abu Bakr Siddeeq Radiallahu Anhu is a Kaafir, and according to some he is an innovator but not a Kaafir. However, the correct view is that he is a Kaafir.
ويَجِبُ إكْفَارُ الرَّوَافِضِ فِي قَوْلِهِمْ بِرَجْعَةِ الْأَمْوَاتِ إلَى الدُّنْيَا (الفتاوي الهندية 2/264)
It is compulsory to declare the Rawafidh (Shias) as disbelievers due to them believing that the dead will return to the world.
When the Kufr of an individual is known with certainty (due to entertaining incorrect beliefs), then performing the Janaazah Salaah of such an individual is prohibited, as mentioned in the following verse of the Quraan Sharif:
وَلاَ تُصَلِّ عَلَى أَحَدٍ مِّنْهُم مَّاتَ أَبَدًا وَلاَ تَقُمْ عَلَىَ قَبْرِهِ إِنَّهُمْ كَفَرُواْ بِاللّهِ وَرَسُولِهِ وَمَاتُواْ وَهُمْ فَاسِقُونَ
.(سورة التوبة/اية:84)
And do not ever perform Salaah upon any of them who dies, and do not stand over their grave. Indeed, they disbelieved in Allah and His Messenger and died as disobedient people.
In conclusion, it will not be permissible to give Ghusl or perform the Janazah Salaah of a Shia that holds beliefs of Kufr as explained above.
