Growing “weed” and using products derived from it
Question:-
Is cannabis/weed allowed to be grown and used for medicinal purposes? People use oils and other items nowadays, which are derived from weed. Some people claim that it is a relief from pain, (not sure if they are smoking or the applying of oil).
Also, in Islam, what is classified as “intoxicants”? What is the period for Ibaadah not being accepte? Is it until the intoxicants are out of the blood stream (if I’m not mistaken, scientifically it’s said to be 40 days), or, is it 40 days regardless of the type?
What’s the ruling regarding smoking cigarettes?
Answer:-
1. The following Hadith is recorded in a narration of Abu Dawud Sharif. Hadrat Abu Darda Radiallahu Anhu narrates that Rasulullah Salallahu Alaihi Wasallam is reported to have said, “Verily Allah Ta’ala sent down the illness and the cure, and Allah Ta’ala has made a cure for every illness, therefore use the treatment/medication but do not use a Haraam treatment.”
In another narration of Abu Dawud, Tirmidhi and Ahmad, it is recorded that Rasulullah Salallahu Alaihi Wasallam prohibited from the usage of impure medication.
عَنْ أَبِي هُرَيْرَةَ قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الدَّوَاءِ الخَبِيثِ (الترمذي)
عَنْ أُمِّ الدَّرْدَاءِ، عَنْ أَبِي الدَّرْدَاءِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: إِنَّ اللَّهَ أَنْزَلَ الدَّاءَ وَالدَّوَاءَ، وَجَعَلَ لِكُلِّ دَاءٍ دَوَاءً فَتَدَاوَوْا وَلَا تَدَاوَوْا بِحَرَامٍ (أبو داود)
Based on the above, we should only utilize permissible forms of medication (whether from pharmaceutical companies, herbal or otherwise) particularly when Halaal medication is available on the market. In Tibbun-Nabawi, the cure for numerous illnesses have been recorded hence, we should act upon the prescriptions recorded therein, as well as recite verses and Surahs of the Quraan Sharif (such as Surah Fateha) which are a cure for many illnesses. Similarly, Allah Ta’ala has kept a natural cure for numerous illnesses in the various types of fruit. In conclusion, when there are numerous ways of curing our illnesses in a Halaal manner, then it will not be permissible to plant weed nor use weed or products derived from weed such as sweets, chocolates, oils etc. for medicinal purposes. We were informed that many of the products manufactured from weed are not actually a cure for illnesses but rather it suppresses the pain due to feeling “high”. Oils applied to the body penetrate the skin and reach the cells, and some even state it reaches the blood stream, whilst other medical experts disagree with it. Be as it may, THC produces what many people consider a ‘high’, pleasure or heightened sensory perception which is naturally found in the cannabis plant. Although this can be isolated from the plant, by law 0.3% of THC is permitted as an ingredient. The ingredient (THC) intoxicates in large quantity hence, it will not be permitted to use even in small quantity.
2. Anything that overpowers the thinking or intellect of a person (where one is unable to think correctly) will be referred to as ‘Khamr – intoxication.’ It is Haraam to consume any such substance in small quantity which intoxicates in large quantity, as explained above.
قال عمر – رَضِيَ اللَّهُ تَعَالَى عَنْهُ -: الخمر ما يخامر العقل، بخلاف القدح المسكر، فإنه يخامر العقل فيكون خمرا من حيث المعنى. (البناية شرح الهداية ص363 ج12)
قَالَ – رَحِمَهُ اللَّهُ – (الشَّرَابُ مَا يُسْكِرُ) هَذَا فِي اصْطِلَاحِ الْفُقَهَاءِ لِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – «كُلُّ مُسْكِرٍ حَرَامٌ» وَهَذَا مَعْنَاهُ.
وَقَالَ بَعْضُهُمْ كُلُّ مُسْكِرٍ خَمْرٌ لِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – «كُلُّ مُسْكِرٍ خَمْرٌ» رَوَاهُ مُسْلِمٌ —– وَلِأَنَّهَا سُمِّيَتْ خَمْرًا لِمُخَامَرَةِ الْعَقْلِ وَكُلُّ مُسْكِرٍ يُخَامِرُ الْعَقْلَ (البحر الرائق ص247 ج8)
وَهَذَا إشَارَةٌ إلَى أَنَّ السَّكْرَانَ مَنْ لَا يُحِسُّ بِشَيْءٍ مِمَّا يُصْنَعُ بِهِ، وَأَكْثَرُ مَشَايِخِنَا – رَحِمَهُمْ اللَّهُ – عَلَى قَوْلِهِمَا، وَحُكِيَ أَنَّ أَئِمَّةَ بَلْخِي – رَحِمَهُمُ اللَّهُ – اتَّفَقُوا عَلَى أَنَّهُ يُسْتَقْرَأُ سُورَةً مِنْ الْقُرْآنِ، فَإِنْ أَمْكَنَهُ أَنْ يَقْرَأَهَا، فَلَيْسَ بِسَكْرَانَ حَتَّى حُكِيَ أَنَّ أَمِيرًا بِبَلْخٍ أَتَاهُ بَعْضُ الشُّرَطِ بِسَكْرَان، فَأَمَرَهُ الْأَمِيرُ أَنْ يَقْرَأَ {قُلْ يَا أَيُّهَا الْكَافِرُونَ} [الكافرون: 1]، فَقَالَ السَّكْرَانُ لِلْأَمِيرِ: اقْرَأْ أَنْتَ سُورَةَ الْفَاتِحَةِ أَوَّلًا، فَلَمَّا قَالَ الْأَمِيرُ {: الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ} [الفاتحة: 2]: فَقَالَ قِفْ، فَقَدْ أَخْطَأْت مِنْ وَجْهَيْنِ تَرَكْت التَّعَوُّذَ عِنْدَ افْتِتَاحِ الْقِرَاءَةِ، وَتَرَكْت التَّسْمِيَةَ (المبسوط للسرخسي ص30 ج24)
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَا أَسْكَرَ كَثِيرُهُ، فَقَلِيلُهُ حَرَامٌ (سنن ابي داود ص327 ج3)
- If a person consumes wine (or any other substance that will overpower his mind), then Allah Ta’ala will not accept his Salaah for 40 days. If he repents, then his Taubah will be accepted. If he drinks for the second time, then again his Salaah will not be accepted for 40 days. If he repents again, then his Taubah will be accepted. If he drinks for the third time, then again his Salaah will not be accepted for 40 days and if he repents, then his Taubah will be accepted. However, if he drinks for the fourth time, then his Salaah will not be accepted for forty days and if he repents, then Allah will not accept his Taubah and he will be made to drink from Nahr-ul-Khabaal (the pus of the people of the Jahannam). عَنْ عَبْدِ اللَّهِ بْنِ عُبَيْدِ بْنِ عُمَيْرٍ، عَنْ أَبِيهِ، قَالَ: قَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ شَرِبَ الخَمْرَ لَمْ تُقْبَلْ لَهُ [ص:291] صَلَاةٌ أَرْبَعِينَ صَبَاحًا، فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ، فَإِنْ عَادَ لَمْ يَقْبَلِ اللَّهُ لَهُ صَلَاةً أَرْبَعِينَ صَبَاحًا، فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ، فَإِنْ عَادَ لَمْ يَقْبَلِ اللَّهُ لَهُ صَلَاةً أَرْبَعِينَ صَبَاحًا، فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ، فَإِنْ عَادَ الرَّابِعَةَ لَمْ يَقْبَلِ اللَّهُ لَهُ صَلَاةً أَرْبَعِينَ صَبَاحًا، فَإِنْ تَابَ لَمْ يَتُبِ اللَّهُ عَلَيْهِ، وَسَقَاهُ مِنْ نَهْرِ الخَبَالِ» قِيلَ: يَا أَبَا عَبْدِ الرَّحْمَنِ: وَمَا نَهْرُ الخَبَالِ؟ قَالَ: نَهْرٌ مِنْ صَدِيدِ أَهْلِ النَّارِ،: هَذَا حَدِيثٌ حَسَنٌ وَقَدْ رُوِيَ نَحْوُ هَذَا عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو، وَابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ (الترمذي)
- Smoking is Makrooh-e-Tahreemi.
