Gym fees

Question:-

A student at our Madrasah paid the yearly fee for the usage of the gym. Is he entitled to a refund if he doesn’t make use of the facilities made available to him?

Answer:-

If any student hires the services of the Madrasah gym (and pays the yearly fee) but doesn’t make use of the services available (for the year) without a valid reason (such as laziness), then he will not be entitled to a refund.

However, if he is unable to utilize the facility due to a valid reason (such as having to leave the Madrasah and moving over to another Madrasah), then he may be charged up to the period that he remained in the Madrasah. On leaving the Madrasah, the Ijaarah agreement should be cancelled (on the basis of him not being able to take further benefit from the gym), in which case he will be entitled to a refund.

ومن استأجر رجلا ليذهب إلى البصرة فيجيء بعياله فذهب فوجد بعضهم قد مات فجاء بمن بقي فله الأجر بحسابه لأنه أوفى بعض المعقود عليه فيستحق العوض بقدره (الهداية 281 ج3)

وتفسخ الإجارة بالأعذار عندنا (الهداية 299 ج3)

الْإِجَارَةُ تُنْقَضُ بِالْأَعْذَارِ عِنْدَنَا وَذَلِكَ على وُجُوهٍ إمَّا أَنْ يَكُونَ من قِبَلِ أَحَدِ الْعَاقِدَيْنِ أو من قِبَلِ الْمَعْقُودِ عليه وإذا تَحَقَّقَ الْعُذْرُ ذُكِرَ في بَعْضِ الرِّوَايَاتِ أَنَّ الْإِجَارَةَ لَا تُنْقَضُ وفي بَعْضِهَا تُنْقَضُ وَمَشَايِخُنَا وَفَّقُوا فَقَالُوا إنْ كانت الْإِجَارَةُ لِغَرَضٍ ولم يَبْقَ ذلك الْغَرَضُ أو كان عُذْرٌ يَمْنَعُهُ من الْجَرْيِ على مُوجَبِ الْعَقْدِ شَرْعًا تَنْتَقِضُ الْإِجَارَةُ من غَيْرِ نَقْضٍ (الفتاوي الهندية ص458 ج4)
