Janaazah Salaah After Asr And Fajr

QUESTION:

Is a female allowed to perform the Janaazah Salaah after the Asr and Fajr Salaah in the Haramain Shareefain? Considering that Nafl Salaah is not permissible at these times, does the same ruling apply for Janaazah Salaah in the Haramain?

ANSWER:

Women should not come to the Haram for Salaah. Yes, they may come to the Haram for Tawaaf in Makkah Sharif or offering Salaam in Madinah Sharif. The Janaazah Salaah is generally performed after the Fardh Salaah in the Haramain, while women are encouraged to perform their Salaah in their rooms, hence women wouldn’t generally be present in the Haramain when Janaazah Salaah is taking place so there is no question of them participating in the Janaazah Salaah. However, if they participated in the Salaah in the past, it would be valid.

Now, coming to the queried scenario, it is permissible to perform Janaazah Salaah after Fajr and Asr Salaah. However, to perform it at the time of sunrise, Zawaal and at the time of sunset is Makrooh (abhorrent).

(‌وكره ‌نفل) قصدا ولو تحية مسجد (وكل ما كان واجبا) لا لعينه بل (لغيره) وهو ما يتوقف وجوبه على فعله (كمنذور وركعتي طواف) وسجدتي سهو (والذي شرع فيه) في وقت مستحب أو مكروه (ثم أفسده) ولو سنة الفجر (بعد صلاة فجر و) صلاة (عصر) ولو المجموعة بعرفة (لا) يكره (قضاء فائتة و) لو وترا أو (سجدة تلاوة وصلاة جنازة وكذا) الحكم من كراهة نفل وواجب لغيره لا فرض وواجب لعينه (بعد طلوع فجر سوى سنته) لشغل الوقت به تقديرا، حتى لو نوى تطوعا كان سنة الفجر بلا تعيين
قال العلامة ابن عابدين: (قوله: وكره نفل إلخ) شروع في النوع الثاني من نوعي الأوقات المكروهة وفيما يكره فيها، والكراهة هنا تحريمية أيضا كما صرح به في الحلبة ولذا عبر في الخانية والخلاصة بعدم الجواز، والمراد عدم الحل لا عدم الصحة كما لا يخفى. (الدر المختار و حاشية ابن عابدين 1/374)
