QUESTION:
What is the Kaffarah of breaking an oath?
ANSWER:
The Kaffarah of a wealthy person (one who owns the Nisaab of Zakaat) is to feed ten poor people (who are eligible to receive Zakaat), an average meal that one would feed his family, or clothe ten poor people, or free a slave. The option of freeing a slave is not applicable in our times due to slavery being abolished. A poor person (who is unable to discharge the above-mentioned Kaffarah due to poverty) will discharge his Kaffarah by fasting for three days. The option of fasting is not available to a wealthy person.
كفارة اليمين ما ذكر الله تعالى في قوله تعالى: لَا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الْأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ بعد هذا ينظر ان كان الحالف موسراً فكفارته احد الأشياء الثلاثة و لا يجزئه الصوم وان كان معسراً فكفارته الصوم المحيط البرهاني 6/367)
