Making a building officially a Masjid

QUESTION:

How is a place declared a Masjid? Does it require an independent entrance? Are there any other requirements?

ANSWER:

The Fuqaha have mentioned that a building does not officially become a Masjid by merely building it. It is officially recognized as a Masjid when the donor verbally mentions that this is a Masjid, he opens an independent doorway to it, and there is general permission for all the people to enter it. Furthermore, the Adhaan and Iqaamah is called out in it and Salaah is performed in it with Jamaat. In conclusion, it must be separated from one’s possession by having a separate entrance to it, or by demarcating it with a boundary wall or fence, together with having its independent entrance.

وفي الملتقط الناصري: وإذا بنى مسجدا لايصير مسجدا حتى يقر بلـسـانـه أنـه مسجد لا يباع ولا يوهب ولا يرهن ولا يورث وفتح الباب وأذن فيه وأقيم وأذن لـلـنـاس بالدخول فيه عامة فيصير مسجدا إذا صلى بجماعة فيه، وقال أبو يوسف: يصير مسجدا بقوله: جعلته مسجدا (الفتاوى التاترخانية 8/156)

اپنی ملک سے علیحدہ کیے بغیر فقط زبانی وقف کرنے کا حکم :

سوال: ایک شخص نے اپنی زمین کا مخصوص حصہ مسجد و مدرسہ بنانے کے لیے وقف کیا ، یہ وقف زبانی ہے ،کوئی تحری نہیں ہے، اس پرتی نہیں کرائی ۔ کیا یہ وقف صحیح ہوا یا نہیں ؟ کیا مسجد و مدرسہ کی زمین الگ کیے بغیر وقف مکمل ہوا یا نہیں؟ بینواتوجروا۔

الجواب: بصورت مسئولہ زبانی وقف صحیح ہے ، وقف کے صحیح ہونے لیے تحر یر ضروری نہیں ہے ، ہاں مسجد کا وقف اس وقت صحیح ہوگا جب الگ کر دے اور جب الگ نہیں کیا تو مسجد کا وقف میچ نہیں ہوا، البتہ مدرسہ کا وقف صحیح ہو گیا ۔ ملاحظہ ہو ہدایہ میں مرقوم ہے:

وإذا بنى مسجدا لم يزل ملكه عنه حتى يفرزه عن ملكه بطريقه ويأذن للناس بالصلاة فيـه فإذا صلى فيه واحد زال عند أبي حنيفة عن ملكه… وقال أبويوسف”: يزول ملكه بقوله: جعلت مسجداً لأن التسليم عنده ليس بشرط لأنه إسقاط لملك العبد فيصير خالصاً لله تعالى بسقوط حق العبد وصار كالإعتاق . (الهداية: ٩/٣ ١)
