Q1. If a Shafi’ee and a Hanafi are negotiating a deal, and according to the Shafi’ee Madhab, the option of Khiyar-e-Majlis (the right to cancel while still in the meeting) exists, but according to the Hanafi school it does not. In such a case, how should the ruling be decided?
A1. The Hanafi should follow his Madhab. As such, he should not opt for Khiyaar-e-Majlis.
Q2. Dawood al-Zahiri says that Riba (interest) only applies to the six items mentioned in the Hadith. If a follower of the Zahiri school trades other items (not from those six) in unequal amounts, will he be sinful?
A2. The Madhab of Dawood Zahiri is not recognised and accepted by the Ulema. Therefore, it is not permissible to follow his Madhab.
Q3. Is it permitted to sell 2 kilograms of Ajwa dates in exchange for 1 kilogram of Sukri dates?
A3. No, it is not permissible as both reasons for Riba are found i.e. Wazn and Jins (dates are sold by weight and both the items are the same i.e. dates irrespective of the type).
عَنْ عُبَادَةَ بْنِ الصَّامِتِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلاً بِمِثْلٍ سَوَاءً بِسَوَاءٍ يَدًا بِيَدٍ فَإِذَا اخْتَلَفَتْ هَذِهِ الأَصْنَافُ فَبِيعُوا كَيْفَ شِئْتُمْ إِذَا كَانَ يَدًا بِيَدٍ )صحيح مسلم #1587)
Ubaadah bin Saamit Radiallahu Anhu reports that Rasulullah Sallallahu Alaihi Wasallam said, “Gold in lieu of gold, silver in lieu silver, wheat in lieu of wheat, barley in lieu of barley, dates in lieu of dates, and salt in lieu of salt, likeness for likeness should be sold with equalness and handed over immediately. If the type of commodities differs, then sell as you wish (without the need for equalness), if the payment is made hand to hand (immediately).”
باب الربا
قال: “الربا محرم في كل مكيل أو موزون إذا بيع بجنسه متفاضلا” فالعلة عندنا الكيل مع الجنس والوزن مع الجنس. قال رضي الله عنه: ويقال القدر مع الجنس وهو أشمل. والأصل فيه الحديث المشهور وهو قوله عليه الصلاة والسلام: “الحنطة بالحنطة مثلا بمثل يدا بيد، والفضل ربا” وعد الأشياء الستة: الحنطة والشعير والتمر والملح والذهب والفضة على هذا المثال. ويروى بروايتين بالرفع مثل وبالنصب مثلا. ومعنى الأول بيع التمر، ومعنى الثاني بيعوا التمر، والحكم معلوم بإجماع القائسين لكن العلة عندنا ما ذكرناه (الهداية 3/60)
