Musaafir

QUESTION:

My parents are flying to India and they’ll stay there for 1 month. In that time, they’ll be staying in the village, and every few days, they will go to the city which is 50kms away and stay there for a few days. They will not stay in either of the places for 15 days. Are they Musaafir?

ANSWER:

In the queried scenario, if your parents will not stay in the village or in the city for 15 days or more, they will be classified as a Musaafir and will read Qasr Salaah.

عن عبد الله بن عمر -رضي الله عنهما قال: إذا كنت مسافرا، فوطنت نفسك على إقامة خمسة عشر يوما، فأتمم الصلاة، وإن كنت لاتدري فاقصر (كتاب الآثار #188)

ونية الإقامة إنما تؤثر بخمس شرائط إلى قوله : واتحاد الموضع. ( الهندية 1/139)

لو نوى الإقامة في موضعين، فإن كان كل منهما أصلا بنفسه نحو مكة ومنى والكوفة والحيرة لا يصير مقيما . (الهندية 1/140)
