Paying A Supplier Twice

QUESTION:

After concluding a business transaction with a person, I transferred payment to an account he had previously used. He then supplied me with a second account and I transferred the funds there. At this point, I had paid him twice for the same service and requested a reversal from the bank. The bank was unhelpful and the person himself has yet to sort this matter out with the banks. Who is liable for the refund in this case?

ANSWER:

Since both the accounts belong to your supplier, as you have stated in your query, then your supplier must refund one amount back to you. It is incorrect of him to keep both the amounts of money when he has only supplied you once.

لَا يَحِلُّ مَالُ امْرِئٍ مُسْلِمٍ إلَّا بِطِيبَةِ نَفْسٍ مِنْهُ (كنز العمال #397)
The wealth of Muslim is not permissible except that he gives it with a happy heart.

لا يحل لامرئ مسلم أن يأخذ مال أخيه بغير حقه (كنز العمال # 30343)
It is not permissible for a Muslim to unjustly take the wealth of his brother.
