QUESTION:
Is “Islamic Profit Share” from FNB halaal?
ANSWER:
The Darul Ifta does not approve of FNB Islamic Banking and their investments, as we are not aware of their modus operandi. We therefore advise that the profits earned through such investments must be given out in charity to a poor person that is eligible to receive Zakaat without the intention of any reward. The Hadith states, “Leave out those things that are doubtful and opt for those things that are doubt-free.” [Mustadrak Alas Saheehain Lil Haakim]
عَنْ أَبِي الْجَوْزَاءِ، قَالَ: سَأَلْتُ الْحَسَنَ بْنَ عَلِيٍّ مَا يَذْكُرُ مِنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: سَمِعْتُهُ يَقُولُ: «دَعْ مَا يَرِيبُكَ إِلَى مَا لَا يَرِيبُكَ، فَإِنَّ الْخَيْرَ طُمَأْنِينَةٌ وَإِنَّ الشَّرَّ رِيبَةٌ» هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ (المستدرك علي الصحيحين للحاكم)
قَالَ عُلَمَاؤُنَا إِنَّ سَبِيلَ التَّوْبَةِ مِمَّا بِيَدِهِ مِنَ الْأَمْوَالِ الْحَرَامِ إِنْ كَانَتْ مِنْ رِبًا فليردها على من أربى عليه، ومطلبه إِنْ لَمْ يَكُنْ حَاضِرًا، فَإِنْ أَيِسَ مِنْ وُجُودِهِ فَلْيَتَصَدَّقْ بِذَلِكَ عَنْهُ (الجامع لأحكام القرآن الكريم للقرطبي 3/366)
ويردونها على أربابها إن عرفوهم، وإلا تصدقوا بها لأن سبيل الكسب الخبيث التصدق إذا تعذر الرد على صاحبه (الدر المختار و حاشية ابن عابدين 6/385(
