Selling one’s assets during one’s final illness

Question:-

If a person in his final illness, before departing from this temporary world, sells his assets to any of his heirs, then would such a sale be valid?

Answer:-

According to Imaam Abu Hanifa Rahimahullah the sale of a person to any of his heirs during his fatal illness is not valid, even though the asset may be sold for its approximate market value or at a price higher than its actual value; unless all the heirs consent to the sale. However, according to the 2 students of Imaam Abu Hanifa Rahimahullah state the sale will be valid if the asset is sold for its approximate market value.

 

 

وَلَا يَجُوزُ بَيْعُ الْمَرِيضِ عَلَى الْوَارِثِ أَصْلًا عِنْدَ أَبِي حَنِيفَةَ وَلَوْ كَانَ بِأَكْثَرَ مِنْ قِيمَتِهِ حَتَّى يُجِيزَهُ سَائِرُ الْوَرَثَةِ وَلَيْسَ عَلَيْهِ دَيْنٌ وَعِنْدَهُمَا يَجُوزُ إذَا كَانَ بِثَمَنِ الْمِثْلِ فَإِنْ حَابَا فِيهِ لَا يَجُوزُ   (الجوهرة النيرة – كتاب الاقرار)

الْحَادِي وَالْعِشْرُونَ بَيْعُ الْمَرِيضِ عَيْنًا من أَعْيَانِ مَالِهِ لِبَعْضِ وَرَثَتِهِ مَوْقُوفٌ على إجَازَةِ الْبَاقِي وَلَوْ كان بِمِثْلِ الْقِيمَةِ عِنْدَهُ  (البحر الرائق – باب البيع الفاسد)
