Taking a vow to go out in Jamaat
Question:-
A person takes a vow if a certain need of his will be fulfilled, then he will go for 40 days in Jamaat. Is such a vow binding?
Answer:-
It is only permissible to take a vow of something that falls in the category of Ibaadat-e-Maqsoodah such as Salaah, Fasting, Zakaat, etc. Since going out in the path of Allah does not fall in the category of Ibaadat-e-Maqsoodah, it will not be correct to take a vow by stating, “If my need is fulfilled, then I will go out in the path of Allah for 40 days.” Hence, in the queried scenario, the vow will not be binding.
وفي البدائع: ومن شروطه ان يكون قربة مقصودة، فلا يصح النذر بعيادة المرضي وتشييع الجنازة والوضوء والاغتسال وان كانت قربا الا انها غير مقصودة (رد المحتار ج٥ص٥١٦)
