Talaaq And Iddah

QUESTION:

My husband and I were having an argument when he said “(My name) I divorce you and there is no condition attached. It is unconditional and irrevocable. You are now in Iddah.” We argued further and he then said that I am as free as a bird to leave at that time.

1. Can he revoke it even though he said it was irrevocable?

2. Am I in Iddah now?

ANSWER:

1. In the queried scenario, one irrevocable Talaaq has taken place. Furthermore, if the husband intended a second Talaaq with the words, “You are free as a bird to leave now,” then another Talaaq will take place as well.

وإذا وصف الطلاق بضرب من الزيادة أو الشدة كان بَائِنا مثل أن يقول أنت طالق بائن أو البتة ” وقال الشافعي رحمه الله يقع رجعيا إذا كان بعد الدخول بها لأن الطلاق شرع معقبا للرجعة فكان وصفه بالبينونة خلاف المشروع فيلغو كما إذا قال أنت طالق على أن لا رجعة لي عليك.

ولنا أنه وصفه بما يحتمله لفظه ألا ترى أن البينونة قبل الدخول بها وبعد العدة تحصل به فيكون هذا الوصف لتعيين أحد المحتملين ومسئلة الرجعة ممنوعة فتقع واحدة بائنة إذا لم تكن له نية أو نوى الثنتين أما إذا نوى الثلاث فثلاث لما مر من قبل ولو عنى بقوله أنت طالق واحدة وبقوله بائن أو البتة أخرى تقع تطليقتان بائنتان لأن هذا الوصف يصلح لابتداء الإيقاع (الهداية 1/232)

2. Yes, your Iddah commenced the moment the Talaaq was issued.
