Omitting the Faraa’idh of Ghusl

Question:-

What is the Hanafi ruling for a person who is 31 years old,  and only now learns, that it is Fardh to gargle and pass water into the nostrils in a Fardh Ghusl.  Must he repeat all his Salaah, Umrah and Hajj? Kindly provide a reference too.

Answer:-

A person in a state of Janaabat is required to gargle the mouth and enter water into the nose up to the soft portion of the nose. This is Fardh (obligatory) in Ghusl, for a person who was in a state of Janaabat. If this person (in the state of Janaabat) performs Ghusl without gargling and passing water into the nostrils, and immediately thereafter performs Salaah, then such a Salaah will not be valid, since the Ghusl was invalid.

وفرض الغسل غسل كل فمه ويكفي الشرب عبا، لان المج ليس بشرط في الاصح (وأنفه) حتى ما تحت الدرن (الدر المختار ص151 ج1)

 

ناک میں پانی دینا غسل جنابت میں فرض ہے  – بغیر اسکے غسل نہیں ہوگا اور بغیر غسل کے نماز نہیں ہوگی  – غسل جنابت کے  علاوہ اور کسی غسل میں پانی دینا فرض نہیں   – فتاوی محمودیہ ص۷۹ ج۵

Notwithstanding the above, if a person performs a Fardh Ghusl in accordance to the Sunnah, whereby he washes his private parts first, then performs a complete Wudhu in accordance to Sunnah, which includes gargling and passing water into the nostrils, and then washes the rest of his body, then his Fardh Ghusl will be valid, since gargling and passing water into the nostrils was achieved in Wudhu. In this case, all his subsequent Ibaadaat will be valid.

Similarly, if a person, in the state of Janaabat, drank water and later performed Ghusl, then the water that he drank will suffice for the Fardh gargling that is required in Ghusl, or if he drank water after Ghusl, then too, the drinking of water will suffice for the Fardh gargling that was required in Ghusl.

Similarly, if a person performed Fardh Ghusl (for example at night or in the early hours of the morning), and then performed Wudhu according to the Sunnah method before performing Fajr Salaah, then his Ghusl (wherein passing water into the nostrils or gargling was omitted) will become valid, since these Faraa’idh have been achieved in the Sunnah Wudhu. In this instance too, all his subsequent Salaah and acts of worship will be valid.

Many perform a fresh Wudhu (in accordance to the Sunnah) before every Fardh Salaah  or even during the day, to recite Quraan Sharif or perform Nafl Salaah, etc. hence, the Fardh Ghusl (that was invalid) becomes valid by performing such a Wudhu.

In conclusion, we cannot state that all the Salaah performed by the person will be invalid. A person should exercise his mind to determine as to what his normal practice has been over the years and accordingly repeat those Salaah that may have been invalid in his estimation.

Finally, if a person performed a Fardh Ghusl (in which gargling and passing water into nostrils was omitted) before donning the Ihraam, but thereafter renewed Wudhu before performing Salaah, Tilaawat or Tawaaf, etc. then all these Ibaadaat after Wudhu will be valid. It is therefore not necessary for one to repeat all the Salaah performed, or the Hajj and Umrah as stated in the query.

ناسيا فصلّٰي ثم تذكّر يتمضمض ويعيد ما صلّي (منية ص14)

غسل  میں کلی کرنا  بھول گیا  بعد میں یاد  ٓایا تو از  سر نو غسل کرے یا صرف کلی کرے ؟

الجواب  : جس   وقت بھی یاد آجائے کلی کرے ،  دو بارہ  غسل کرنے کی ضرورت نہیں   (احسن الفتاوی  ص۳۳ ج۲)

جنابت کی حالت میں کھانے پینے کی اجازت ہے  ، البتہ بغیر کلی کئے پانی پینا مکروہ تنزیھی ہے اور اس میں صرف پہلا گھونٹ مکروہ ہے، کیونکہ یہ  پانی منہ کی  جنابت زائل کرنے میں استعمال  ہوا ہے  ۔۔۔۔[ ٓاپ کے مسائل اور ان کا  حل ص۱۱۶ ج۳]
