Delaying the Fajr Salaah until after sunrise

QUESTION:

1.  A person wakes up for Fajr with only ten minutes before sunrise, and he is in need of taking a Ghusl. It usually takes 15 minutes to make Ghusl, which means he would miss his Fajr. What should he do?

2. What is the ruling where a person is aware that they will miss their Salaah, but chooses to read it later and goes back to sleep?

ANSWER:

1. It is possible for a person to take a Fardh Ghusl and perform the two Rakaats Fardh of Fajr within ten minutes. The Sunnah can be delayed until 15 minutes after sunrise. Hence, if a person gargles his mouth, enters water into the nose, and passes water over the entire body (without using any soaps and shampoo), then he could terminate his Ghusl within a few minutes, and perform the two Rakaats Fardh of Fajr before sunrise. There is no need to take a 15 minute Ghusl when the Fardh Ghusl can be completed within a few minutes.

2. It is a serious sin to return to sleep without performing the Fajr Salaah, or delaying the Salaah until after its time passes.
