Leaders regarding Haraam as Halaal

Question:-

We have seen some ulama in South Africa make Takfīr of the leaders in some Muslim countries (namely due to ruling by other than what Allāh revealed and making the Harām into Halāl e.g. music/alcohol etc. amongst other things).

Please can you clarify if leaders who fall into the aforementioned categories, are indeed non-Muslim and, whether it is appropriate to visit such countries?

Answer:-

By regarding anything that is proven Haraam from Quraan and Hadith to be Halaal, one loses his Imaan. Hence, by considering music and alcohol as Halaal, one loses his Imaan. Visiting a particular country due to a necessity does not become impermissible due to the incorrect belief of an individual. Yes, if there isn’t a need or necessity to visit a particular country, then one should stay at home as far as possible, as the Hadith of Rasulullah Salallahu Alaihi Wasallam states that to attain salvation, one’s home should suffice him.

 

وَإِنْ أَنْكَرَ بَعْضَ مَا عُلِمَ مِنْ الدِّينِ ضَرُورَةً كَفَرَ بِهَا (الدر المختار ص561 ج1)

 

سئل أبو ذر عمن شك في تحريم الربوا او الخمر وهو قريب العهد بالكفر جاهل بحكم الإسلام فقال : متمسك بحكم العقل , فان علم حرمته بالشرع واستحل ذلك كفر (الفتاوي التاتارخانية ص313 ج7)

 

وفي التتمة : من اهان الشريعة او المسائل التي لا بد منها كفر (شرح فقه اكبر  ص215)

 

عن عقبة بن عامر قال قلت يا رسول الله ما النجاة قال املك عليك لسانك وليسعك بيتك وابك على خطيئتك  (صحيح الترغيب والترهيب ص42 ج3)
