Telling the wife, “It’s Haraam to touch you.”

Question:-

Could Mufti Saheb read the following incident and answer the questions below:

The husband and wife were playing and joking around. The wife began calling the husband a name that generally strangers call him. He then said ,”Stop acting like a stranger!”. She continued so he said, “You being like a stranger,” and then said, “It’s Haraam to touch you!”. All this was done whilst they were both joking however, Talaaq was intended by the husband.

The questions are:
1. Has any Talaaq Kinayah or Talaaq Kinayah Bi Hukmi As-Sareeh (Kinayah divorce in the ruling of Sareeh) taken place?
2. Has Iylaa taken place? Also is there any Kaffarah to be given if the husband has relations and wants the marriage to continue?

Please provide clear, correct and relevant references (Ibaarah/Juziyyah) for the answers from Arabic and Urdu Hanafi Fiqh Kutub.

Answer:-

In the queried scenario, a clear Talaaq which is in the ruling of a Talaaq-e-Baa’in has taken place. Generally, a Niyyat is required for Talaaq-e-Baa’in to be effective. However, when using the word ‘Haraam’ upon one’s wife, Talaaq-e-Baa’in occurs even though one may not have the Niyyat of Talaaq.

لفظ حرام طلاق صریح بائن ہے ۔  اس سے بدون نیت بھی طلاق بائن واقع ہوجاتی ہے  (احسن الفتاوی ص۱۸۳ ج۵)

قال في التنوير قال لامراته انت علي حرام (الي قوله) ويفتي بانه طلاق بائن وان لم ينوه وفي الشرح لغلبة العرف (رد المحتار ص601 ج2)

وان كان الحرام في الاصل كناية يقع بها البائن لانه لما غلب استعماله في الطلاق لم يبق كناية ولذا لم يتوقف علي النية او دلالة الحال الخ  (شامي ص717 ج2)
