Building a Masjid with blood money paid in lieu of killing a person

Question:-

A person was killed and as a result, the the family of the deceased was paid the Diyyat (blood money). The family decided to construct a Masjid as Sadaqah-e-Jariyyah on behalf of the deceased. Is this permissible?

Answer:-

The law of inheritance is applicable to the Diyyat money, meaning that, the funds must be distributed amongst the heirs of the deceased person in accordance to the Shari’ee law of succession. If the heirs jointly agree to build a Masjid with the funds due to them, after settling the Marhoom’s debts and fulfilling his bequests, if any, then there is no harm in doing so. Since, they will be building a Masjid on behalf of the Marhoom, it will be a means of Thawaab-e-Jaariyah (perpetual reward) for him Insha’Allah.

واعلم أنه يدخل في التركة الدية الواجبة بالقتل الخطأ أو بالصلح عن العمد أو بانقلاب القصاص مالا بعفو بعض الأولياء، فتقضى منه ديون الميت وتنفذ وصاياه كما في الذخيرة (رد المحتار ص759 ج)
