Business Dispute
Q1. A customer had agreed to pay me for a car bought in instalments over two years. For the duration of the two years, the car would still be under the seller’s name and the log book was going to remain by the seller as well. However, the buyer fraudulently acquired a fake logbook from the licensing department and already sold the vehicle. Then new buyer also sold the vehicle to someone else. Was this permissible for him to do?
A1. No. It is impermissible and against the dignity of a Muslim to carry out such a treacherous and deceitful action by faking the log book. Consider the following Hadith:
عن أبي هريرة رضي الله عنه أن رسول الله صلى الله عليه وسلم قال: من حمل علينا السلاح فليس منا ومن غشنا، فليس منا (رواه مسلم # 170)
Abu Hurairah Radiallahu Anhu narrates that Rasulullah Salallahu Alaihi Wasallam is reported to have said, “He who takes up arms against us is not from amongst us, and he who deceives us is not from amongst us.”
Q2. Does the contract of paying in instalments over 2 years still stand, as he has already sold the vehicle to someone else?
A2. You have stated that your buyer has already sold the car which means that he does have the ability to pay the entire amount of money owed to you. Hence, he should settle the entire amount and not pay in instalments. Consider the following Hadith:
عن أبي هريرة رضي الله عنه أن رسول الله صلى الله عليه وسلم قال: ”مطل الغني ظلم )الترمذي #1309)
Abu Hurairah Radiallahu Anhu narrates that Rasulullah Salallahu Alaihi Wasallam is reported to have said, “It is an act of oppression on the part of a person to procrastinate in fulfilling his obligation.”
Furthermore, Allamah Ibn Nujaim Rahimahullah writes in his Kitaab, Alashbah Wannadhir, that a person will be commanded to give 700 accepted Salaah on the day of Qiyaamah in lieu of usurping one Daaniq (one sixth of a Dirham) from another person.
جَاءَ فِي بَعْضِ الْكُتُبِ أَنَّهُ يُؤْخَذُ لِدَانَقٍ ثَوَابُ سَبْعِ مِائَةِ صَلَاةٍ بِالْجَمَاعَةِ (الأشباه ة النظائر 1/33)
Q3. The debtor goes for Umrah multiple times while this is his condition i.e. he is owing money to people. Is this acceptable?
A3. Unfortunately, this is the trend in our times where a person will be owing monies to his creditor and have so many other obligatory responsibilities to fulfil, but such a person will undertake a journey to perform a Nafl Umrah with no concern to pay off his debts. Indeed, this is not the correct the mindset.
