Miscellaneous Queries On Ihraam
Q1. I mistakenly rubbed a little soap on my body while in Ihraam and then remembered and quickly rinsed it off immediately. What is the penalty?
A1. Fundamentally, using scented products to wash one’s body in the state of Ihraam is prohibited in Shar’iah. If a scented product is applied to a complete limb, such as the hand, then a penalty known as Damm will be enforced. Damm means to sacrifice an animal within the precincts of the Haram Sharif.
If it is applied to a small limb, such as the nose, eyes, or ears, then only Sadaqah will be necessary.
Accordingly, you will have to gauge that the scented soap was applied to what extent of the body, and then discharge either Sadaqah or Damm.
وَفِي المنتَقى هِشَام عَن محمَدٍ رَحِمَه الله إذَا غَسَل المحرِم يَدَه بِأَشنَانٍ فَيْهِ طِيْب فَإِن كَانَ إِذَا نَظَروا إِلَيه قَالوا هَذَا أَشْنَان فَفِيهِ الصَدَقَة وَإِن قَالوا هوَ طِيب فَعَلَيهِ الدَم وَعَنه أَيضاً لَا بَأسَ أَن يَأكلَ المحرِم الزَيتَ وَدَهن الشح وَأَن يقطرَ في أذنِه الزَيتَ قَالَ لِأن هَذَا طَعَام وَطِيب يَعنِي الزَيتَ طَعَام وطِيب مِن حَيث إنه أَصل الطِيبِ فَإِذَا لم يستَعمَلَه عَلى وَجهِ الطِيبِ لَا يظهَر حكم الطيبِ بِخِلَافِ البنفَسج وَأَمثَاله لِأَنه طِيب بِنَفسِهِ. وَفِي الْهِدَايَةِ: وَكُلُّ صَدَقَةٍ فِي الْإِحْرَامِ غَيْرُ مُقَدَّرَةٍ فَهِيَ نِصْفُ صَاعٍ مِنْ بُرٍّ إلَّا مَا يَجِبُ بِقَتْلِ الْقَمْلَةِ وَالْجَرَادَ (الدر المختار و حاشية ابن عابدين 2/543)

Q2. I forgot that I was in Ihraam and bit my wife on her cheek playfully. I remembered I was in Ihraam and stopped immediately. What is the penalty?
A2. If you had perceived some lust at the time of biting her cheeks, then a Damm will be necessary. If there was no lust then Damm will not be necessary.
الجناية هنا ما تكون حرمته بسبب الإحرام أو الحرم وقد يجب بها دماء أو دم أو صوم أو صدقة ففصلها بقوله ( الواجب دم على محرم بالغ ) …( أو قبل ) عطف على حلق (أو لمس بشهوة أنزل أو لا) في الأصح (الدر المختار و حاشية ابن عابدين 2/ 543)
