Fiqh for minorities
Question:-
Assalamualaikum,
Attached is a booklet called, ‘Fiqh for minorities’ which was published by JUSA and released during an Ulama conference.
What is the Darul ifta’s stance on such a concept?
Please clarify for the Ulama and public!
Answer:-
We do not approve of the booklet titled ‘Fiqh for Minorities.’ Success lies in following the Deen of Allah and His Rasul Salallahu Alaihi Wasallam in its original form, without any form of adulteration whatsoever. The A’immah Mujtahiddeen, who were blessed with in-depth knowledge of Deen (in all sciences) and a very high level of Taqwa, had extracted the laws of Deen (directly from the Quraan and Hadith) and presented it in the most perfect manner to the Ummah to practice upon. Hence, we as Muqallids of the Hanafi Madhab will follow the Madhab as presented by the Imaam of the Madhab and his students. Leaving the Madhab and formulating one’s own laws of Fiqh, is nothing but deviation which will lead to everlasting destruction. Also, by approving such booklets, a great deal of division and disunity will be created within the Ummah. It is for this reason that, when there are several views in the Madhab on a particular matter, it is not permissible to issue a verdict on any of the views. Rather, it is necessary for all the Muftis to pass a verdict on the preferred view of the Madhab, as the remaining views in the Madhab are like non-existent.
