QUESTION:
I hired a gardening service for a once-off garden clean-up, and they damaged a gutter while they were busy removing the trees. Is the gardening service liable for the damages of the gutter?
ANSWER:
If the gardening service did not adopt the necessary procedures and means of protection as required, and therefore the gutters were damaged (due to negligence), then they will be held liable for damaging the gutters. However, if all the necessary measures were adopted but the gutters were damaged due to error, then they cannot be held liable.
