Giving One’s Wife an Allowance

QUESTION:

What is the ruling regarding a husband providing Nafaqah for the wife? If a husband buys all the groceries in the house, pays the rent, lights and water, is it still necessary to give his wife an allowance over and above this for her to use on herself or as she wishes?

ANSWER:

Fuqaha (Jurists) state that it is necessary for the husband to fulfil the needs of the wife which refer to her basic needs according to the norm of society. Some of the jurists have stipulated certain things, namely roti or bread, curry, flour, water, firewood (stove), salt, oil, items required for her adornment and beautification, clothing, necessary furniture and goods of the house, accommodation, and if the wife is from such a family that has access to a domestic worker, then a helper too.

To give her spending money/allowance is not part of her Nafaqah. Yes, if he gives her some allowance/cash over and above all her needs, then it will be a gift from the husband and he will be rewarded for it.

النفقة الواجبة : المأكول، والملبوس، والسكنى، أما المأكول فالدقيق، والماء، والحطب، والملح والدهن. وفي جامع الجوامع، والنفقة الواجبة : الأكل والشرب، واللبس، والسكني، والرضاع وكذا خادم تحتاج إليه

نفقہ کے انواع اور مشتملات قرآن وحدیث اور شریعت کے مزاج و مذاق کو سامنے رکھنے سے معلوم ہوتا ہے کہ بیوی کے نفقہ میں اس کی تمام بنیادی ضروریات شامل ہیں جو ہر زمانے اور عرف کے لحاظ سے مختلف ہوتے ہیں، تاہم بعض فقہا نے ان کی تعیین وتحدید کرتے ہوئے سات چیزوں کا ذکر کیا ہے : طعام ( روٹی ) ، سالن ، صفائی ستھرائی اور ضروری زینت کا سامان، لباس، گھر کا ضروری اثاثہ اور سامان ، رہائش گاہ اور اگر عورت ایسے سماج سے تعلق رکھتی ہو جس میں خدام سے کام کیا جاتا ہے تو خادموں کا نظم بھی ان چیزوں میں شامل ہے (فتاوی عثمانیه 6/391)

شریعت مطہرہ نے شوہر پر بیوی کے نان و نفقہ کی ادائیگی کی جو ذمہ داری ڈالی ہے، اس سے مراد معاشی طور پر عورت کی بنیادی ضروریات کا پورا کرنا ہے جس میں کھانا، پینا، رہائش اور لباس جیسی چیزیں شامل ہیں، چنانچہ ان ضروریات کو اپنی معاشی کیفیت اور توفیق کے مطابق پورا کر لینے سے یہ واجبی ذمہ داری ادا ہو جائے گی ، جب کہ رقم دینا نان و نفقہ کی ادائیگی کا لازمی جز نہیں ہے..
