QUESTION:

If one has to shoot an animal from a distance and then rush to slaughter it, in which cases will it be permitted to eat the meat, and in which will it be impermissible? Kindly explain if there is any difference of opinion as well.

ANSWER:

If an object with a sharp edge or point, such as an arrow, was used whilst reciting the Tasmiyah to hunt down the animal, and it is certain that the animal has died because of the wound caused by the pointed edge of the arrow, then it will be permissible to consume the animal.

With regards to shooting with a bullet, there is a lot of difference amongst the senior Muftis regarding the hunted animal being Halaal or not. Below we have quoted some of the senior Ulama who consider the animal to be Haraam as there is uncertainty whether the animal died because of the wound, or due to the impact of the bullet:

The view of the Darul Ifta concurs with their view.

Yes, one may argue that some bullets also have sharp points. However, then too, there is no certainty whether the animal died due to the wound or the impact of the bullet, hence, it is considered as Haraam as a precautionary measure. We hope the above explanation clarifies the issue. See the following text of the Fuqaha:

ولا يؤكل ما أصابته البندقة فمات بها لأنها تدق وتكسر ولا تجرح، فصار كالمعراض إذا لم يخزق.. والأصل فيه ما روي «عن عدي – رَضِيَ اللَّهُ عَنْهُ – قال: سأل رسول الله – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – عن صيد المعراض.. وهو قول أكثر أهل العلم.(البناية 12/449)

(أو بندقة ثقيلة ذات حدة) لقتلها بالثقل لا بالحد، ولو كانت خفيفة بها حدة حل؛ لقتلها بالجرح، ولو لم يجرحه لا يؤكل مطلقا.. (قوله ولو كانت خفيفة) يشير إلى أن الثقيلة لا تحل وإن جرحت. قال قاضي خان: لا يحل صيد البندقة والحجر والمعراض والعصا وما أشبه ذلك وإن جرح؛ لأنه لا يخرق إلا أن يكون شيء من ذلك قد حدده وطوله كالسهم وأمكن أن يرمي به؛ فإن كان كذلك وخرقه بحده حل أكله، فأما الجرح الذي يدق في الباطن ولا يخرق في الظاهر لا يحل لأنه لا يحصل به إنهار الدم؛ ومثقل الحديد وغير الحديد سواء، إن خزق حل وإلا فلا اهـ.(الدر المختار و حاشية ابن عابدين 6/471)
