Question:-
The Kaffarah of Zihaar is as follows:
– freeing a slave (not disabled)
– feeding 60 poor people
– keeping 60 fasts continuously
What if a person has no slaves so he can’t free any?
He is very poor himself so he can’t feed 60 people.
He has an illness so he can’t keep 60 fasts continuously.
What will he discharge as Kaffarah? Will the ruling not apply to him?
Answer:-
A person who does not have the financial ability to feed 60 poor people, nor is he able to keep 60 fasts consecutively due to ill health, then such a person should delay his Kaffarah of Zihaar until he is able to do any of the above.
وإن كان عليه كفارة القتل أو الظهار أو الإفطار ولم يجد ما يعتق وهو شيخ كبير لا يقدر على الصوم ولا يجد ما يطعم في كفارة الظهار والإفطار يتأخر الوجوب إلى أن يقدر على الإعتاق في كفارة القتل وعلى الإعتاق أو الإطعام في كفارة الظهار والإفطار لأن إيجاب الفعل على العاجز محال والله أعلم.(بدائعالصنائع5/112)
ولا ترتفع الحرمة إلا بالكفارة فتلزمه الكفارة ضرورة إيفاء الواجب على الأصل المعهود أن إيجاب الشيء إيجاب له ولما لا يتوصل إليه إلا به كالأمر بإقامة الصلاة يكون أمرا بالطهارة ونحو ذلك والله أعلم.(بدائعالصنائع3/236)
