Lost And Found Items

QUESTION:

Over the weekend we stopped at a popular rest-stop for travellers, and found jewelry in the parking lot. We kept it with us as we felt this was the safest option. We called the owner of the establishment informing him of the events, and left our contact details with him. Please advise us how to resolve this matter.

ANSWER:

The ruling regarding lost funds or lost items is that an effort should be made to locate the owner by putting up notices and advertising through social media, in the marketplaces, and the place where the item was found. If the lost item is worth more than 10 Dirhams (which is approximately R430.00), then it should be advertised for a period of one year, and if the value is between 3 and 10 Dirhams, then the notice should be kept up for a month. If the value of the item is between 1 and 3 Dirhams, then the notice should be kept up for a week, and if it is less than 1 Dirham, then it should be advertised for a day.

له أن يعرف اللقطة، والتقدير بالحول ليس بعام لازم في كل شيء، وإنما يعرفها مدة يتوهم أن صاحبها يطلبها وذلك يختلف بقلة المال وكثرته حتى قالوا في عشرة دراهم فصاعدا: يعرفها حولا؛ لأن هذا مال خطير يتعلق القطع بسرقته ويتملك به ما له خطر… وفيما دون العشرة إلى ثلاثة يعرفها شهرا، وفيما دون ذلك إلى الدرهم يعرفها جمعة، وفي دون الدرهم يعرف يوما (المبسوط للسرخسي 3/11)

If the owner doesn’t claim the item within the stipulated period, then it should be given to a poor person who qualifies as a recipient of Zakaat. If the finder qualifies as a recipient of Zakaat, then he may keep the item for himself.

 يجوز للملتقط أن ينتفع باللقطة إذا كان فقيرا وإن لم يكن فقيرا لم يجز ويتصدق بها على الفقير أجنبيا كان أو قريبا له أو زوجة له لأنه مال الغير فلا يجوز الانتفاع به بدون رضاء لإطلاق النصوص كقوله تعالى ولا تأكلوا أموالكم بينكم

 وإن كان الملتقط غنيا لم يجز له أن ينتفع بها لأنها مال الغير فلا يباح له الانتفاع به إلا برضاه والإباحة لأنه محل للصدقة بالإجماع قوله وإن كان فقيرا فلا بأس أن ينتفع بها لأنه ذو حاجة (الجوهرة النيرة 1/357)
