Najaasat falling in a pool

QUESTION:

If there is a body of water e.g. a pool, which is 3m x 6m and 1.5-2m deep, and Najis falls inside, will the water be considered Najis? Is only the area of the water taken into account? What is considered a large quantity of water if not only the area is considered?

ANSWER:

If impurity falls into a pool or pond and reaches the other side (by using the one side of the pool or pond), then it will be considered as a small pool or pond. If impurity falls into a small pool or pond, then it causes the entire pool or pond to become Napaak. If by using the one end of the pool, the impurity does not reach the other end, then the pool or pond will be considered as a big pool or pond and will not become Napaak (if impurity falls into it). According to Imaam Abu Hanifa Rahimahullah, it will be left to one to decide whether a pool or pond falls in the category of a large pool or pond or in the category of a small pool or pond. Some of the current day Akaabireen Muftis have estimated a large pool to be 20.09 square meters taking the width and length into consideration. The depth of the pool is not taken into consideration. Hence, if impurity falls in a pool that is 20.09 square meters or more then it will not cause the pool to become impure. Yes, if the pool is less than 20.09 square meters then it will become impure by impurity falling in it.

In the case of a circular pool, if the diameter of the pool is 5.16 square meters or more then it will be considered as a large pool, otherwise not. [Re:- Ahsanul Fataawa Pg.45 Vol.2]    

 In the scenario cited by you in the query, the pool is 18 square meters in size which will be considered as a small pool, hence it will become Napaak by impurity falling into it.

و في الينابيع قال أبو حنيفة الغدير العظيم هو الذي لا يخلص بعضه الي بعض و لم يفسره في ظاهر الرواية وفوضه الي راي المبتلى به وهو الصحيح و به اخذ الكرخي وهكذا في اكثر كتب ائمتنا فثبت بهذه النقول المعتبر عن مشايخنا المتقدمين مذهب امامنا الأعظم ابي حنيفة و ابي يوسف و محمد (البحر الرائق ج١ص١٣٨-١٣٩)
