Next Salaah time sets in while performing the previous Salaah

QUESTION:

1. If a person were to delay the Zuhr Salaah, and while reading, the time of Asr sets in, what should he do?

2. If Asr is being read, and Maghrib Athaan is called, what should a person do in this case?

ANSWER:

1. The Zuhr Salaah will be valid if the Asr Salaah time enters while completing the Zuhr Salaah.  However, if a person is performing Fajr Salaah and the sun rises, or Eid Salaah is being performed and the sun moves away from its zenith, or Jumuah Salaah is being performed and Asr time enters, then in these cases the Salaah will have to be repeated.

واذا أراد ان يصلي ظهر يومه وعنده ان وقت الظهر لم يخرج وقد خرج الوقت فنوي ظهر اليوم جاز (الفتاوي التاتارخانية ص41 ج2)

وبالتحريمة فقط بالوقت يكون أداء عندنا، وبركعة عند الشافعي والاعادة فعل مثله (الدر المختار ص97 ج1)

2. If a person is performing Asr Salaah and the sun sets (meaning that the time of Maghrib enters), then he should complete his Salaah, and there will be no need to repeat the Salaah. However, one should refrain from doing so in future, as one is sinful for delaying the Salaah to this extent.

وكره صلاة مطلقا مع شروق واستواء وغروب الا عصر يومه فلا يكره فعله (شامي ج٢ ص٣٢)

الا عصر يومه عند الغروب، لان السبب هو الجزء القائم من الوقت، وإذا كان كذلك فقد اداها كما وجبت، بخلاف غير ها من الصلاة، لأنه وجبت كاملة فلا تتادي بالنقض (هداية ج١ص٨٥)
