Nikaah After Talaaq Baain

Feb 25, 2026 | Talaaq (Divorce)

QUESTION:

A woman was divorced from her husband for the second time with a Talaaq Baain. Can their Nikaah be solemnized before her Iddah period ends? Will she need a Wali to represent her, and are the witnesses required to be Mahram to her?

ANSWER:

Talaaq Baain terminates the marriage. In order to reconcile, the couple must renew the Nikaah with a new Mahr. This can be done either during the Iddah period, or after it has terminated.

Furthermore, the same procedure should be adopted when performing the second Nikaah, i.e the Wali should seek permission in the presence of two witnesses who are Mahrams. If the witnesses are non-Mahrams, then the Purdah of the woman will be compromised. Hence, we advise against it.
