QUESTION:
A woman became Paak before Sehri, however, she was not completely sure because the days were less than her normal cycle. She made sehri but did not make Niyyah because of uncertainty. Later during the day she realized that she was Paak and remained like a fasting person throughout the day. Is the fast valid, or does she have to make Qadha?
ANSWER:
If there was no Niyyat of fasting the fast will not be valid, hence the lady will be required to make Qadha.
قَالَ – رَحِمَهُ اللَّهُ – (هُوَ تَرْكُ الْأَكْلِ وَالشُّرْبِ وَالْجِمَاعِ مِنْ الصُّبْحِ إلَى الْغُرُوبِ بِنِيَّةٍ مِنْ أَهْلِهِ) وَهَذَا فِي الشَّرْعِ وَهُوَ أَحْسَنُ مِنْ قَوْلِ الْقُدُورِيِّ الصَّوْمُ هُوَ الْإِمْسَاكُ عَنْ الْأَكْلِ وَالشُّرْبِ وَالْجِمَاعِ نَهَارًا مَعَ النِّيَّةِ لِأَنَّهُ أَشْمَلُ (تبيين الحقائق ص312 ج1)
