QUESTION:
We are about to start renovations to our Masjid. The old carpets, door frames, rubble etc will be disposed of, and whatever is salvageable, will be given away. However, a person wishes to donate to the Masjid. Would it be correct if he donates through buying all the old things at a fixed price, and then he can discard or distribute as he pleases? Can this transaction be concluded now, as rubble etc, will become available in the future during the course of the renovations?
ANSWER:
Yes, the old carpets, doors and rubble of the Masjid may be purchased at a fair price from the trustees of the Masjid. The amount received from the sale of these items may be used in the renovation of the Masjid. It is possible to remove the sold items and hand them over to the seller, hence the transaction may be concluded immediately with the proviso that the goods being sold are known to both parties.
وإذا راي حشيش المسجد فرفعه انسان جاز ان لم يكن قيمة فان كان له ادني قيمة لا يأخذه الا بعد الشراء من المتولي او القاضي او اهل المسجد (البحر الرائق ج٥ص٢٥١)
