Rabb-ul-Maal (investor in a Mudhaarabah investment) renting his premises out to the Mudaarib (investment agent)

Question:-

Zaid enters into a Mudhaarabah agreement with Bakr. Zaid is the Rabb-ul-Maal (investor) and Bakr is the Mudhaarib (investment agent). Can Bakr hire Zaid’s premises to carry out business?

 

Answer:-

It is understood from the text of the Fuqaha (jurists) that the Mudhaarib can transact with the Rabb-ul-Maal. Ijaarah is also considered as a transaction; therefore the Rabb-ul-Maal may rent out his premises to the Mudhaarib in the queried scenario.
