Fatwa of Imaam Muhammad R.A in regards to Haidh which will create ease during Hajj and Ramadaan

Question:-

A woman bled for 2 days. The bleeding then ceased for a period of 10 days. The bleeding resumed on the 11th day. Will this be considered as continuous bleeding? It is recorded in Hidaayah that when the bleeding is less than 15 days it is considered as continuous bleeding as it is Tuhr-e-Faasid. Some women experience this scenario in Ramadaan and during Hajj because of which they experience great difficulty. Is there any way out in the Kitaabs of Fiqh?

 

Answer:-

In the questioned scenario, the two days are considered as Istihaadha according to Imaam Muhammad Rahimahullah. The ten days thereafter will be counted as Tuhr and the bleeding that follows, if it continues for 3 days or more then it will be counted as Haidh, and if it is less than 3 days then it will be Istihaadha. Some of the jurists have issued the Fatwa on the view of Imaam Muhammad due to the difficulty experienced by women in Ramaadan and during Hajj.

 

The narration of Hasan Bin Ziyaad which he took from Imaam Abu Hanifa Rahimahullah states, when a clean period of 3 days occurs between two bleedings, then it will be considered as Tuhr. It is not necessary for the days of bleeding to be more or equal.
