Relatives Objecting To Nikaah
QUESTION:
My father’s brother son got married while my father and his brothers were unhappy about it. The parents of the groom were accepting of the Nikaah. Is there any Shar’i exception to this Nikaah?
ANSWER:
In the above-mentioned scenario, the Nikaah is already contracted by Ijaab (offer) and Qabool (acceptance), and the disapproval of certain relatives does not render the marriage invalid. In this scenario, the parents agreed to the marriage of their son, and this is sufficient.
(وَأَمَّا رُكْنُهُ) فَالْإِيجَابُ وَالْقَبُولُ، كَذَا فِي الْكَافِي وَالْإِيجَابُ مَا يُتَلَفَّظُ بِهِ أَوَّلًا مِنْ أَيِّ جَانِبٍ كَانَ وَالْقَبُولُ جَوَابُهُ هَكَذَا فِي الْعِنَايَةِ
