Question:-
Zaid intends selling his vehicle to Amr. Before concluding the transaction, he tells Amr, “If there is any defect in the vehicle then I will not be responsible, so you should check the vehicle properly before purchasing it.” In other words, he is buying the vehicle ‘As Is’ or ‘Voetstoets.’ Is such a transaction in order, and if Amr finds a fault in the vehicle later on, what will be the ruling?
Answer:-
The transaction will be valid. Amr doesn’t have the right of claiming from Zaid at a later stage since the vehicle was sold to him ‘As is’ or ‘Voetstoets.’ However, if the seller happily and voluntarily refunds Amr (due to the purchaser being dissatisfied), then there is no problem in doing so.
