Service Fee On EFT

QUESTION:

Can we charge a service fee to a person doing an EFT in lieu of cash? For example, accepting cash and carrying comes with a high risk of endangerment.

ANSWER:

Yes, it is permissible on condition that there is mutual agreement between both the parties for charging a service fee, and the service that is being rendered is known to both the parties.

يشترط في صحة الإجارة رضاء العاقدين (المجلة ص 86)

يشترط في الإجارة أن تكون المنفعة معلومة بوجه يكون مانعاً للمنازعة  (المجلة ص 86)

وفي اصطلاح الفقهاء بمعنى بيع المنفعة المعلومة في مقابلة عوض معلوم (شرح المحلة 2/478)
