QUESTION:
If one’s marriage is annulled and reconciliation is only possible after renewing the Nikah once the Iddat has terminated, then is it permissible to talk to one’s husband during the Iddat period, or is it already Haraam?
ANSWER:
An annulled marriage is categorized as a Talaaq-e-Baa’in. If you are currently serving your Iddat, you may renew the Nikah during the Iddat period with your ex-husband. It is not necessary to wait until the Iddat period has ended. However, you are not permitted to engage in conversation with your husband until the Nikah is renewed. If you intend marrying another person other than your husband, then you will have to serve your Iddat in full.
ويجوز لصاحب العدة ان يتزوجها لان النهي عن التزوج للأجانب لا للازواج (بدائع الصنائع ص446 ج5)
وَيَجُوزُ لِصَاحِبِ الْعِدَّةِ أَنْ يَتَزَوَّجَهَا، كَذَا فِي مُحِيطِ السَّرَخْسِيِّ. هَذَا إذَا لَمْ يَكُنْ هُنَاكَ مَانِعٌ آخَرُ سِوَى الْعِدَّةِ، كَذَا فِي الْبَدَائِعِ. (الفتاوي الهندية ص280 ج1)
وَيَجُوزُ لِصَاحِبِ الْعِدَّةِ أَنْ يَتَزَوَّجَهَا فِي عِدَّتِهَا إِذَا لَمْ يَكُنِ الطَّلاَقُ ثَلاَثًا لأَِنَّ النَّهْيَ عَنِ التَّزَوُّجِ لِلأَْجَانِبِ لاَ لِلأَْزْوَاجِ؛ لأَِنَّ عِدَّةَ الطَّلاَقِ إِنَّمَا لَزِمَتْهَا حَقًّا لِلزَّوْجِ، لِكَوْنِهَا بَاقِيَةً عَلَى حُكْمِ نِكَاحِهِ مِنْ وَجْهٍ، وَهَذَا يَظْهَرُ فِي حَقِّ التَّحْرِيمِ عَلَى الأَْجْنَبِيِّ لاَ عَلَى الزَّوْجِ إِذْ لاَ يَجُوزُ أَنْ يُمْنَعَ حَقَّهُ (1) .
