Unintentional Talaaq Due To Illness

Oct 27, 2026 | Talaaq (Divorce)

QUESTION:

I suffer from Lupus. This disease affects my nervous system and my body.
I cannot control my mental state at times and I say and do things that I don’t intend to on a normal day. During one of these episodes I insisted on my husband issuing a Talaaq.
My husband’s response was, “I give to you Talaaq in order for my condition to subside.” He explained that he had no intention of Talaaq.
Due to my illness and circumstances, please advise if my Nikaah is still in tact?

ANSWER:

In the queried scenario, Talaaq will take place even though the husband did not intend it due to clear words of Talaaq being used. Furthermore, after our telephonic conversation, you had stated that this was the third Talaaq that your husband had issued. As such, you are now Haraam upon him and must immediately separate from him and commence your Iddah.
