Using Electricity Gratis

QUESTION:

My mother has municipality prepaid electricity at home. From 2024, her meter started adding units on its own, so she stopped buying electricity. Last month, her electricity was cut and she was told that it was due to illegal use. In order to reconnect, she would have to backpay her account. She was advised to wait for a technician to reconnect her electricity and provide her with the outstanding charges. That evening the electricity was restored, and to date, no one has come to the house to give us the amount. Please advise what our next step should be?

ANSWER:

You should wait for few weeks. If no one comes to give the amount, then you should go to the office and inform them that the electricity has been reconnected and there was no bill or charge forthcoming, since you are well aware that you are using the electricity and not paying for it, which is not permissible.

لَا يَحِلُّ مَالُ امْرِئٍ مُسْلِمٍ إلَّا بِطِيبَةِ نَفْسٍ مِنْهُ (كنز العمال #397)

The wealth of Muslim is not permissible except that he gives it with a happy heart.

لا يحل لامرئ مسلم أن يأخذ مال أخيه بغير حقه  (كنز العمال # 30343)

It is not permissible for a Muslim to unjustly take the wealth of his brother.

(مادة ٥٩٦) لو استعمل أحد مالاً ١٢٦ بدون إذن ٣٠٣ و ٣٠٤ صاحبه فهو من قبيل الغاصب ٨٨١ لا يلزمه ضمان منافعه ولكن إن كان مال وقف أو مال صغير فحينئذ يلزمه ضمان المنفعة أي أجر المثل بكل حال ٤١٤ وإن كان معداً للاستغلال يلزمه ضمان المنفعة يعني أجر المثل ٤١٤ إذا لم يكن بتأويل ملك ٥٩٧ أو عقد ٥٩٨ مثلاً لو سكن أحد في دار آخر مدة بدون عقد ١٠٣ إجارة ٤٠٥ لا تلزمه الأجرة ٤٠٤ لكن ان كانت الدار وقفاً او مال صغير فعلى كل حال يعني إن كان ثمة تأويل ملك أو عقد أو لم يكن يلزم أجر مثل المدة التي سكنها، وكذلك إن كانت دار كراء ولم يكن ثمة تأويل ملك أو عقد يلزم أجر المثل . وكذا لو استعمل احد دابة الكراء ٤٠٤ بدون اذن صاحبها يلزم أجر المثل (انظر المادة ٨٦) )المجلة ص 109)
