Zakaah
Q1. We have disadvantaged students at the Madrassah, for whom we use Zakaat to assist with their fees, transport etc. Can any amount be given for them on their behalf, so long as it does not exceed Nisaab amount?
A1. Yes, any amount can be given, as long as it doe not exceed the amount of Nisaab which is currently R 12 516.43 (09 Dhul Hijjah 1446). To give more than the Nisaab amount is Makrooh.
” ويكره أن يدفع إلى واحد مائتي درهم فصاعدا وإن دفع جاز ” وقال زفر رحمه الله لا يجوز لأن الغني قارن الأداء فحصل الأداء إلى الغني ولنا أن الغني حكم الأداء فيتعقبه لكنه يكره لقرب الغني منه كمن صلى وبقربه نجاسة (الهداية 1/112)
Q2. Does it have to be a specified amount for fees and transport, or can a stipulated amount be given per child with the understanding that it is for fees, transport and the running of the Madrassah expenses as well?
A2. When Zakaat is given to a student, he is at liberty to use it as he wishes. Hence, you should not stipulate how he should utilize that money. Yes, the Ustaadh of the Madrassah can become a Wakeel for the student. This can be done by making the student sign a Wakaalat document, which should state that the Ustaad will be taking possession of Zakaat funds on behalf of the student. This will then be used for paying his fees, transport etc.
Q3. Can a person use the Zakaat funds on a monthly basis or only when all other monies are used up? For example, only once all the Lillah and Sadaqah funds have been depleted, then the Zakaat funds can be used.
A3. Once the money has been acquired, it may be used. You will not have to wait for the Lillah and Sadaqah money to be used up first.
