Zakaah And Mudhaaraba
QUESTION:
Suppose I enter into a valid Mudaarabah contract with another party, where I provide the capital as the Rab-ul-Maal while the other party manages the investment as the Mudhaarib. The profit is shared between us according to an agreed percentage. My intention is to keep the investment for the long term and benefit from the profit generated, rather than to trade or sell my investment for capital gain.
In such a situation, how should Zakaah be calculated on my investment?
Is Zakaah payable on the entire capital amount plus the profit, or only on the profit/return actually received?
Does the fact that the investment is held for long term to generate income, rather than for trading or capital appreciation, affect the Zakaah ruling?
If the underlying Mudarabah business consists primarily of productive or income-generating assets, rather than cash and trading inventory, does this affect the Zakaah treatment of the investor’s capital?
If the investor cannot determine the exact proportion of the underlying Mudarabah assets that are Zakaatable, is there a Shari basis for paying Zakaah on the income/returns only rather than on the entire capital?
ANSWER:
From the outset, it is imperative to note that Zakaah is only discharged on Zakaatable assets. Zakaatable assets are cash at home, cash in the bank, gold, silver, inventory, raw materials, any other savings or investments, loans owed, etc.). Furthermore, in a partnership, each partner will discharge Zakaah in his own individual capacity i.e. if his share with all his other Zakaatable assets reach the amount of Nisaab, then he will discharge Zakaah, otherwise not.
You have stated in your query, “If the underlying Mudarabah business consists primarily of productive or income-generating assets, rather than cash and trading inventory,” –according to our understanding by “primarily of productive or income-generating assets “, you intend a property, machinery etc. If so, then Zakaah is not obligatory on a property or machinery, rather it will be obligatory on the income of the property or the products and goods produced from the machinery. As such, you will not take that value of the property or machinery into consideration when calculating your Zakaah.
