Zakaah Distribution In A Partnership

QUESTION:

In a business partnership, Party A invested 25% capital and does labour. Party B invested 75% capital and does no labour. Their agreement is 50% sharing in profits and losses. They give 100 000 in Zakaah of stock. How is the Zakaah proportioned?

ANSWER:

Zakaah is paid individually based on the shares. Therefore, party A will pay 25% and party B will pay 75%.

قَالَ أَصْحَابُنَا: إنَّهُ يُعْتَبَرُ فِي حَالِ الشَّرِكَةِ مَا يُعْتَبَرُ فِي حَالِ الِانْفِرَادِ وَهُوَ كَمَالُ النِّصَابِ فِي حَقِّ كُلِّ وَاحِدٍ مِنْهُمَا فَإِنْ كَانَ نَصِيبُ كُلِّ وَاحِدٍ مِنْهُمَا يَبْلُغُ نِصَابًا تَجِبُ الزَّكَاةُ وَإِلَّا فَلَا.
