Zakaah For A Baaligh Child
QUESTION:
I recently paid Zakaah as Madrassah fees for a Baaligh child. I did establish from the mother at that time that the child did not possess the Nisaab and offered to pay it after informing the mother. I paid the full year’s fees, transferring it into the mothers bank account.
Two months later I became aware that the family is planning to go for Umrah in June. I was informed that the mother was saving to go for Umrah.
My concern is whether my Zakaah has been discharged correctly based on my assumption that the mother would have been in possession of her savings to pay for the fees before I offered to pay it.
ANSWER:
In the queried scenario, the Zakaah will be discharged since the child is Baaligh and does not possess the Nisaab, on condition that the mother was made a Wakeel to take possession of the Zakaah funds which were to be used to pay the Madrassah fees. (Re:Fatawaa Darululoom Zakariyya Vol:3 Pg:213)
واما ولد الغني فان كان صغيرا لم يجز الدفع اليه وان كان فقيرا لا مال له لان الولد الصغير يعد غنيا بغني ابيه وان كان كبيرا فقيرا يجوز لإنه لا يعد غنيا بمال ابيه……(بدائع الصنائع ج٢ص٤٧)
