Talaaq using the words, ‘Go from here!’

Question:-

My husband and I were involved in a heated argument, and I asked him for a divorce. He kept ignoring me but I kept asking for it, to which he said “Go from here!”. He said that he didn’t intend divorce but wanted me to leave the room so that he doesn’t have to listen to me. Does it still constitute a divorce?

Answer:-

In the queried scenario, Talaaq will not be effective even though you were requesting Talaaq and your husband responded by saying, ‘Go from here’. The words, ‘Go from here!’ were used to reject your request of Talaaq and to turn you away. Your query states that your husband’s intention was to make you leave the room, as he was not prepared to accommodate your request of Talaaq, hence, Talaaq will not take place (in your case) even though you were discussing or requesting Talaaq from him. The jurists have written that certain words of divorce such as ‘Go from here!’ can be used in response to a request of Talaaq, or as a rejection to the request for Talaaq. Hence, if the husband states that he didn’t intend Talaaq with these words, then his word will be accepted and Talaaq will not be effective.

(والكنايات ثلاثة أقسام) .

الأول: م: (ما يصلح جوابًا وردًّا لا غير) ش: أي جوابًا لسؤال المرأة الطلاق وردًّا لكلامها عند سؤالها.

الثاني: م: (وما يصلح جوابًا لا ردًّا) ش: أي لا يصلح ردًّا.

الثالث: م: (وما يصلح جوابًا ويصلح سبًّا وشتيمة) ش: فإذا عرف هذا يعرف حكم هذه الأقسام م: (ففي حال الرضا لا يكون شيء منها) ش: أي من هذه الألفاظ م: (طلاقًا إلا بالنية) ش: للاحتمال وعدم دلالة الحال: (والقول قوله) ش: أي قول الزوج: م: (في إنكار النية لما قلنا) ش: إشارة غلى قوله لأنها غير متنوعة للطلاق بل يحتمله وغيره.

م: (وفي حال مذاكرة الطلاق لم يصدق) ش: أي الزوج م: (فيما يصلح جوابًا ولا يصلح ردًّا في القضاء) ش: يتعلق بقوله يصدق، أي لا يصدق قضاء في أنه لم ينو الطلاق م: (مثل قوله خلية برية بائن بتة حرام اعتدي أمرك بيدك اختاري) ش: هذه ثمانية ألفاظ ومثله يصلح جوابًا ولا يصلح ردًّا في حال مذاكرة الطلاق، وقد ذكرنا معانيها عن قريب م: (لأن الظاهر أن مراده الطلاق عند سؤال الطلاق) ش: لأن كلامه جواب لسؤالها الطلاق والسؤال يصلح مفادًا في الجواب، والقاضي مأمور باتباع الظاهر م: (ويصدق فيما يصلح جوابًا وردًّا مثل قوله: اذهبي، اخرجي، قومي، تقنعي، تخمري، وما يجري هذا المجرى) (البناية شرح الهداية ص367 ج5)
