QUESTION:
A person intending to perform Qurbani should refrain from clipping the nails before the commencement of Dhul Hijjah. Is the same ruling applicable to the Haji who performs Qurbani?
ANSWER:
Yes, it is Mustahab (preferable) to clip the nails before the commencement of Dhul Hijjah for those intending to make Qurbani, according to the Hanafi school of thought. However, it is recorded in Ghunyatun Naasik, that it is preferable for the Mutamatti and the Makki to perform Ghusl, remove unwanted hair, clip one’s nails, apply scent, etc. before donning the Ihraam for Hajj. This clearly indicates that the ruling applicable to one intending Qurbani is not applicable to one performing Hajj, as the Haji should cleanse himself before donning the Ihraam. However, if the Haji does refrain from clipping the hair or nails from the beginning of Dhul Hijjah, then there is no harm in doing so. You should consult a Shafi’ee Mufti for a ruling in the Shafi’ee Madhab on the above matter.
قال في شرح المنية وفي المضمرات عن ابن المبارك في تقليم الأظفار وحلق الرأس في العشر أي عشر ذي الحجة قال لا تؤخر السنة وقد ورد ذلك ولا يجب التأخير اهـ ومما ورد في صحيح مسلم قال رسول الله صلى الله عليه وسلم إذا دخل العشر وأراد بعضكم أن يضحي فلا يأخذن شعرا ولا يقلمن ظفرا فهذا محمول على الندب دون الوجوب بالإجماع فظهر قوله ولا يجب التأخير إلا أن نفي الوجوب لا ينافي الاستحباب فيكون مستحبا إلا إن استلزم الزيادة على وقت إباحة التأخير ونهايته ما دون الأربعين فلا يباح فوقها )الدر المختار و حاشية ابن عابدين 2/181)
ما ينبغي قبل إحرام الحج وبعده
فإذا أراد المتمتع، وكذا المكي أن يُحرم بالحج يأتي بما سبق له في الإحرام من إزالة التفث، والاغتسال والتطيب وغير ذلك أو يكتفي بالاغتسال إن لم يحل من عمرته، ثم يدخل المسجد ويطوف سبعًا، ثم يصلي ركعتي الطواف، ثم يصلي ركعتين سُنّةَ الإحرام، ويُحرم عقيبهما وحج كالمفرد إلا أنه لا يطوف للقدوم، ويرمل في طواف الزيارة، ويسعى بعده.(غنية الناسك ص345)
